Membership Terms & Conditions DEFINITIONS. In this
Agreement, "BLOCK", “BLOCK Gym” or “The Club” refers to Cheriton
Group Melville Ltd, T/A Block Gym at Melville Building, Royal William Yard,
Plymouth, PL1 3RP, a company registered in England and Wales (registration
number 13082362), whose registered office is Pynes Hill Business Centre, Pynes
Hill, Exeter, Devon, United Kingdom, EX2 5JL. "I" means the person
whose name appears on the Membership Agreement.
1. COOLING OFF PERIOD. If I wish to cancel this Agreement, I
may do so by emailing written notice to BLOCK Gym. The notice must say that I
do not wish to be bound by the Agreement and must be delivered before midnight
on the fourteenth day from the Agreement date. BLOCK will refund anything I
have paid, but the refunded amount will be less an amount for the membership I
have already used (if any) at the then-current one-day pass rate. This will be
calculated on a per-swipe basis. If the amount of use surpasses the initial
fees paid, my membership will be terminated immediately, however no refund will
be issued. Refunds will be made no later than 28 days after the day on which
the Club was informed about my decision to cancel. The refund will be made
using the payment method I used for the initial transaction; there are no cash
refunds.
2. MEMBER OBLIGATIONS. This Agreement is a legally binding
obligation for which I am financially responsible. I agree not to conduct any
kind of commercial or business activity in the Club and will not act as a
personal trainer for anyone within the Club. I understand I am responsible for
updating my address and contact information, and following the Club Usage Terms
& Conditions at all times, along with any verbal instruction from BLOCK
staff.
3. MEMBERSHIP CANCELLATION.
After my right to cancel period noted earlier (if any), I must cancel my membership by giving written notice to the club. This can be done by emailing gym@blockplymouth.co.uk. Should I wish to cancel, I must provide written notice at least ten days before the end of the month. If notice is received after this 10-day period, my membership will continue through the following month, and I will retain access and be liable for payment accordingly. I understand that cancelling my direct debit mandate does not automatically cancel my membership, and I need to give written notice to the club of my intentions to cancel. If payment cannot be collected at the start of the month, I understand that BLOCK Gym reserves the right to end my membership without notice. I am aware that if I use the facilities and payment cannot be collected, I will be expected to pay the current one-day pass rate based on a per-swipe basis.
4. MEMBERSHIP FREEZE. I have the right to freeze my
membership for a minimum of one month and up to three months per year, during
which time I will not be charged standard membership dues. I must provide
written notice at least ten days in advance of my next billing cycle. I may
incur a processing charge of £3 for each frozen month. A membership cannot be
cancelled during a freeze period.
5. FACILITIES AND SERVICES. The Club reserves the right at
any time to delete, discontinue, repair or replace the facility equipment
without any effect on this Agreement. The Club may be closed for up to two
weeks each year for maintenance purposes.
6. PRICES. From time to time, and not more than once per
year, BLOCK may need to increase the price of my membership fees. The Club will
give at least 30 days’ notice of any incoming price increase, and will make it
very clear when the price increase will take effect and how much my membership
will cost after the increase. During this period, I will have my usual right to
terminate my membership in accordance with the membership terms and conditions.
If I do not terminate the membership by the date given to me in the notice then
the price of my membership will be increased in accordance with the notice
provided.
7. MINIMUM AGE. All membership holders of the club must be a
minimum 16 years of age.
8. LIMITATION OF LIABILITY. I agree that, except for any
legal responsibility that BLOCK Gym cannot exclude in law (such as for death or
personal injury), BLOCK is not legally responsible for any: (i) losses that (a)
were not foreseeable to me and them when the contract was formed or (b) were
not caused by any breach on the part of BLOCK; (ii) business losses; or (iii)
losses to non-consumers. 9. ACCESS CONTROL. I understand that only authorised
members or guests may access the Club and I am not permitted to share my Access
Card / Access Device with anyone else. Appropriate access control has been
issued to enable me to securely access the Club in accordance with the terms of
my membership. If I lose or misplace an issued access card, I need to contact
the Club to remove the card immediately. If I require a replacement card, I
understand I will be charged for a replacement at the then-current rate.9.1.
Club access is monitored 24/7: In the interests of the safety and security of
all our members, Club access is monitored and individuals using Access Cards /
Access Devices may be asked to provide proof of identification when requested
by BLOCK staff.
9.2. What we will do if we think your Access Card / Access
Device has been misused: Should we believe that your Access Card / Access
Device has been used by another individual or individuals we may (in our
discretion) decide to conduct an investigation. If we do so we will: (a) inform
you, via email, that we believe your Access Card / Access Device has been used
by another individual or individuals and ask you to provide us with reasonable
assistance to investigate the matter; and (b) following our investigation we
will contact you, via email, to inform you of our findings and our proposed
course of action, which may include one or more of the steps set out in
paragraph 9.3 below.
9.3. Our Right to make additional charges and/or cancel your
membership: If you unreasonably refuse to cooperate with our investigation, or
following our investigation we have reasonable grounds to believe that your
Access Card / Access Device was used, with or without your knowledge and/or
consent, by another individual or individuals, depending on the particular
circumstances of each case, we reserve the right to take one or both of the
following steps, which are in addition to any other legal rights that we may
have : (a) to apply a penalty charge to your membership fees (and increase your
direct debit payment(s) accordingly). The penalty charge will be calculated as
being equal to the then-current one-day pass rate (that applied at the time of
use) for each occasion on which entrance to the Club was gained by that
individual / those individuals; and/or (b) in the event of serious misuse of
your Access Card / Access Device, for example, entrance to the Club has been
made on repeated occasions and/or by more than one individual, to notify you,
via email, that we are cancelling your membership with immediate effect, and no
refunds will be given.
9.4. Your responsibility for another’s conduct: If we have
reasonable grounds for believing that you knowingly provided your Access Card /
Access Device to another individual or individuals, or allowed unauthorised
entry following your entry to the gym (Known as tailgating) in addition to our
rights referred to in paragraph 9.3 above, we may hold you responsible for the
conduct of the individual(s) while on BLOCK premises, and liable for any loss
we suffer as a consequence of that conduct.
10. MISCELLANEOUS. This is the whole Agreement between the
parties with respect to the Membership Terms and Conditions and supersedes any
prior understandings or agreements of the parties whether written or oral,
express or implied. With the exception of pricing changes from time-to-time as
noted above, this Agreement may not be amended or modified except in a writing
signed by both parties.
11. PAYMENT AUTHORISATION. For purposes of this payment
authorisation, the term "I" refers to the new member whose name
appears above as the primary account holder and on the Membership Agreement.
"You" refers to the financial institution where I hold an account. I
authorise you to pay membership fees on my behalf to BLOCK Gym, in the amount
of the membership plan I have selected (inclusive of VAT at 20%). These
payments will continue until I submit a written notice of cancellation of my
membership to the Club as instructed in this agreement. I agree I am bound by
the membership payment terms and unpaid account balance due upon cancellation.
I agree that you will be fully protected in honouring these direct debits and
that your treatment of them and rights in respect to them are the same as if
personally signed by me. I understand that I must notify the Club of account
changes and that I may incur an additional fee whenever there is a payment
default. I understand that if I terminate the agreement or cancel the direct
debit in a manner not described in the agreement, I may be liable to BLOCK for
damages for breach of contract.
12. CAR PARKING. BLOCK Gym Members can benefit from
90-minutes car parking per day within the Royal William Yard, when parking in a
marked public space. Car parking must be validated upon each visit. BLOCK
reserves the right to amend or remove this offering at any time, and will not
be liable for any parking charges incurred. All car parking queries, or appeals
must be made directly to SIP Car Parks, Peter House, Oxford Street, Manchester,

13. PHYSICAL CONDITION AND NO MEDICAL ADVICE. I confirm that
I am in good physical condition and have no medical reason or impairment that
would prevent me from my intended use of BLOCK Gym. I understand and
acknowledge that BLOCK will not and cannot provide me with any medical advice.
If I have any health or medical concerns now or after I join, I will discuss
them with my doctor before using the facilities.
14. EQUIPMENT INDUCTION. Upon joining, all new members will
be offered a tailored gym introduction, if this is not offered to you, or you
decline this appointment, you must seek advice/instruction from a qualified
member of BLOCK Gym staff before using any equipment you are unfamiliar with.
BLOCK will not accept any liability for any claim for personal injury if you
use the gym equipment having not undertaken an induction from a qualified
member of BLOCK Gym staff.
15. GUEST REQUIREMENTS. I understand I may be expected to
show proper identification when I enter the facility, and will be required to
sign in as directed by BLOCK staff.
16. RULES AND REGULATIONS. I agree to follow any club rules
posted at the club or communicated by BLOCK staff, subsequent to those laid out
in these Terms & Conditions. BLOCK Gym may, in its sole discretion, modify
its rules or policies without notice at any time.
17. DAMAGED, LOST OR STOLEN PROPERTY. I understand that the
BLOCK is not responsible for any of my personal property that is damaged, lost
or stolen whilst inside, or near, the Club. I understand and agree that I am
liable for all damage I cause to the equipment or physical infrastructure of
the club facility and will reimburse BLOCK for any damage I cause.
18. VIDEO NOTICE. I may not take unauthorised photos or
videos anywhere in the Club. I understand that the Club uses unmonitored video
surveillance and access card usage is logged, which both may be retained by the
Club for future use.
19. CLASS BOOKING. Members must arrive promptly for class
start times; late arrival may result in being refused entry to the class.
19.1. Members are recommended to book in advance to ensure
that a class has space for them.
19.2. Members can book classes 7-days in advance
19.3. Our classes get full. If a member is unable to attend,
they should cancel at least 3-hours in advance of the class to allow other
members the opportunity to take their spot. If a class is full a member can
book onto a waiting list
19.4. BLOCK Gym operates with a strict non-attendance
policy, whereby two no-shows within a 30-day rolling period will result in an
automatic 7-day booking ban. Any future classes you have booked will also be
Cancelled
20. MEMBER CONDUCT. You must not behave in an aggressive,
abusive, anti-social or threatening manner to any staff or member, any one
doing so will have their membership terminated immediately and BLOCK Gym
reserves the right to contact the Police if deemed necessary.
20.1. You may not use the gym whilst under the influence of
alcohol, narcotics, tranquilizers or any medication or other substance which
may affect your ability to exercise safely. BLOCK Gym reserves the right to
remove you from the premises if it reasonable believes you are unfit to use the
facilities.
20.2. Smoking, including e- cigarettes are strictly
prohibited in all areas of the gym. Any member found to be breach of this rule
may have their membership terminated.
20.3. I understand that the Club bans the use of anabolic
steroids and I agree not to use, sell or exchange steroids on the Club’s
premises.
20.4. Bags are not to be taken onto the gym floor, and
members are encouraged to use the lockers provided. Lockers are to be used for
the duration of your training session only, all lockers will be emptied at
night and members items removed to lost property. Padlocks may be broken to
gain access and will not be replaced by BLOCK.
20.5. Pets are not to be brought into the Club, with the
exception of registered service animals. Please inform Club Management upon
joining if you require to bring a service animal into the facility.
20.6. Upon entering and exiting the Club, specifically
between the hours of 22:00-07:00, members are expected to be respectful of the
local area, keeping noise to a reasonable level and following signposted
traffic control measures
21. GENERAL GYM ETIQUETTE. For safety reasons, correct
attire must be worn when exercising i.e., suitable comfortable exercise
clothing and appropriate footwear. Clothing such as jeans, boots,
flip-flops/sandals or work wear are not permitted. Suitable clothing must be
worn at all times, removal of clothing for posing and/or photos is not
permitted within the facility. Any member not wearing suitable attire, or found
to be removing items of clothing within the Gym or Studio, may be asked to
leave the gym.
21.1. All equipment, including all free weights, is to be
put back in its original place after use, failure to do so may result in your
membership being terminated.
21.2. Please do not misuse the weights by dropping them on
the floor, excessive dropping or slamming of weights may result in your
membership being terminated.
21.3. Wipe down kit once you have used it with the cleaning
products provided. Cleaning stations and wipes are available in the gym for you
to use.
21.4. Be courteous to other BLOCK Gym members at all times.
Where possible, allow suitable distance for other members to exercise
efficiently and do not use the same piece[s] of equipment for excessive periods
of time.
